1. Acceptance of Terms
By registering for an account or using any Fynexamp service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must immediately cease using our services. These Terms form a legally binding agreement between you and Fynexamp.
2. Account Eligibility
You must be at least 18 years of age (or the legal age in your jurisdiction) to open an account. By registering, you represent that you are legally permitted to trade financial instruments in your country of residence. Fynexamp reserves the right to refuse or close accounts that do not meet eligibility criteria or that are opened from restricted jurisdictions.
3. Description of Services
Fynexamp provides an online platform for trading Contracts for Difference (CFDs) on various underlying instruments including Forex, Stocks, Indices, Commodities, and Cryptocurrency. All products are offered as CFDs; Fynexamp does not facilitate direct ownership of underlying assets. Trading is available subject to market hours and instrument-specific conditions.
4. User Obligations
You agree to:
- Provide accurate and complete information during registration and keep it updated.
- Maintain the confidentiality of your account credentials and not share access with third parties.
- Notify Fynexamp immediately of any unauthorised use of your account.
- Use the platform solely for lawful purposes and in compliance with applicable laws.
- Complete KYC verification as required before making deposits or withdrawals above specified thresholds.
5. Prohibited Use
You must not use Fynexamp services to:
- Engage in market manipulation, wash trading, or any form of fraudulent activity.
- Launder money or finance illegal activities.
- Attempt to reverse-engineer, scrape, or disrupt our platform.
- Circumvent geographic or account restrictions through the use of VPNs, proxies, or misrepresentation.
- Engage in automated trading strategies that cause abnormal system load without prior written consent.
6. Intellectual Property
All content on the Fynexamp platform — including software, design, trademarks, logos, text, and data — is owned by Fynexamp or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the platform for personal trading purposes. Any reproduction, modification, or commercial use without written permission is strictly prohibited.
7. Fees and Charges
Fynexamp earns revenue through spreads on CFD transactions, overnight financing charges (swaps) on positions held beyond the trading day, and in certain circumstances, withdrawal processing fees. A full and current schedule of charges is available in your account settings and may be updated with 30 days' notice.
8. Risk Acknowledgment
You acknowledge that trading CFDs involves a high level of risk and may not be suitable for all investors. You may lose all of your deposited capital. By trading with Fynexamp, you confirm that you understand these risks and that you are trading with funds you can afford to lose. Please review our full Risk Warning before trading.
9. Limitation of Liability
To the maximum extent permitted by law, Fynexamp shall not be liable for any indirect, incidental, special, or consequential losses arising from your use of our services, including but not limited to trading losses, loss of profit, or data loss. Our total aggregate liability in any circumstance shall not exceed the total fees paid by you to Fynexamp in the three months preceding the event giving rise to the claim.
10. Termination
Fynexamp may suspend or terminate your account at any time if you breach these Terms, if required by regulatory obligation, or at our sole discretion with reasonable notice. Upon termination, any open positions may be closed and outstanding balances returned, subject to outstanding obligations.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by mandatory local law in your jurisdiction.
12. Changes to Terms
Fynexamp reserves the right to amend these Terms at any time. We will provide at least 14 days' notice of material changes via email or in-platform notification. Your continued use of our services after the effective date of any revision constitutes acceptance of the updated Terms.
